Local court holidays: the detail that can make a filing untimely

Municipal holidays, optional days off and system downtime: how each one affects the count.

A filing made on the last day may be deemed untimely for a reason that has nothing to do with the merits: a holiday that wasn't on your calendar. The opposite also happens — a lawyer files unnecessarily early because they didn't know the deadline had been extended.

Business days are not the same across Brazil

The CPC requires counting in business days (art. 219) and extends the deadline to the next business day when the start or the end falls on a day without court business (art. 224, § 1). What changes from place to place is which days are business days:

  • National holidays, valid for all courts;
  • State holidays and dates specific to each state court;
  • Municipal holidays of the judicial district;
  • Suspensions of court business ordered by the court itself (administrative orders).

System downtime counts too

When the e-filing system is unavailable, the general rule is that a deadline falling on that day is extended to the next business day, according to the rules of the court and of the National Council of Justice (CNJ). That's why it is worth keeping proof of the downtime, usually published on the court's own portal.

Prove the local holiday in your appeal

A frequently debated point: timeliness based on a local holiday must be demonstrated by the appellant. When in doubt, attach the document proving the holiday (court order, municipal law or certificate) when filing the appeal. This simple step keeps a well-grounded appeal from being dismissed.

Good practices to avoid mistakes

  1. Keep a calendar for each court and district where you practice;
  2. Update it with the suspension orders published throughout the year;
  3. Count the deadline on the day the notice arrives, not the day before it is due;
  4. Record the basis of the calculation (which holiday was considered) together with the deadline.
